Municipal Corporation of Delhi:

List of documents required for mutation of land / house in Delhi –

A) In case of Transfer: –

  • Notice in Form-A
  • Copy of valid instrument(s) of transfer – deed of such transfer must be duly stamped and registered. Transfer duty on such stamp duty must have been paid;
  • Possession letter / mutation, if any;
  • Application for mutation with Rs.3/- Court fee stamp affixed on it;
  • Indemnity Bond on Rs.100/- Stamp Paper duly attested by Notary;
  • Affidavit on Rs.10/- Stamp Paper duly attested by Notary (Annex-A);
  • Clearance of up-to-date Property Tax;
  • Apportionment fee of Rs.100/- per assessee for each period of assessment alongwith compounding fee of Rs.50/- (wherever applicable) for each default u/s 128(1), 128(2) and 128(3) of the Delhi Municipal Corporation Act.

B) In case of devolution/inheritance: –

  • Notice in Form-B
  • Death Certificate of earlier owner;
  • Copy of Will along with codicil (if applicable) or Succession Certificate;
  • Indemnity Bond on Rs.100/- Stamp Paper duly attested by Notary;
  • Affidavit on Rs.10/- Stamp Paper duly attested by Notary (Annex-B);
  • Affidavit / No objection from other legal heir(s) / co-assessee(s) on Rs.10/-Stamp Paper duly attested by Notary in case of “Unregistered Will” (Annexure-C);
  • In case of Registered Will, affidavit from the person on whom the title devolves;
  • Clearance of up-to-date Property tax;
  • Apportionment fee of Rs. 100/- per assessee for each period of assessment alongwith compounding fee of Rs. 50/- (wherever applicable) for each default u/s 128(1), 128(2) and 128(3) of the Delhi Municipal Corporation Act.

C) In case of Power of Attorney / agreement to sell: –

  • Notice in Form-A
  • Copy of Power of Attorney duly registered in the office of Sub-Registrar;
  • Copy of Agreement to Sell duly registered in the office of Sub-Registrar;
  • Copy of Will;
  • Receipt of payment duly registered by Sub-Registrar;
  • Application for mutation with Rs.3/-Court fee stamp affixed on it;
  • Indemnity Bond on Rs.100/- Stamp Paper duly attested by Notary;
  • Affidavit on Rs.10/- Stamp Paper duly attested by Notary (Annex-A);
  • Clearance of up-to-date Property Tax;
  • Apportionment fee of Rs. 100/- per assessee for each period of assessment alongwith compounding fee of Rs. 50/- (wherever applicable) for each default u/s 128(1), 128(2) and 128(3) of the Delhi Municipal Corporation Act.
  • In case the will is not registered, no objection from other legal heirs in favour of the beneficiaries is insisted upon by the Department. Mutation once allowed, shall not be cancelled without prior approval of the Assessor & Collector.

D) In case of Death:

Mutation of residential flats/plots in death cases where a will has been left by the allottee/ lessee /sub-lessee:

  • Affidavit
  • Indemnity Bond
  • Relinquishment Deed.
  • Death Certificate in Original
  • Proof of relationship, viz., copy of ration card, or copy of passport, or copy of voter’s identity card, duly attested by gazetted officer/Notary Public/Magistrate.
  • NOC or redemption deed, if plot is mortgaged.
  • One photograph & Three Specimen Signatures of Mutatee duly attested by Class-I Gazetted Officer/Ist class Magistrate.
  • NOC from the society (In case of a Society plot).
  • Copy of “D” form/completion Certificate duly attested.

E) In case of Will:

Mutation of residential flats/plots on the basis of will in favour of family members:

  • Affidavit
  • Indemnity Bond
  • In case the “Will” is unregistered NOCs from all the class I legal heirs for mutation in favour of legatee.
  • Certified copy of the “Will” left by the allottee/lessee/sub-lessee.
  • Death Certificate in Original.
  • Proof of relationship, viz., copy of ration card, or copy of passport or copy of voter’s identity card, duly attested by gazetted officer/Notary Public/Magistrate.
  • Copy of “D” form/completion Certificate.
  • One photograph & Three Specifimen Signatures of mutatee duly attested by Class I Gazetted Officer/Ist class Magistrate.
  • NOC or redemption deed, if plot is mortgaged.
  • NOC from the society (In case of a Society plot)

F) In case of Will outside blood relations

Mutation of residential flats / plots on the basis of will outside blood relations

  • Affidavit
  • Indemnity Bond
  • Certified copy of “Will” left by ALLOTTEE/LESSEE/SUBLEASEE.
  • Original Death Certificate.
  • Copy of Ration Card or copy of Passport or copy of voter’s identity card etc. duly attested.
  • Copy of “D” Form/Completion Certificate.
  • One photograph and three specimen signatures of mutatee duly attested by Class-I gazetted Officer.
  • NOC or redemption deed, if plot is mortgaged.
  • A certified copy of assessment order of Income Tax and House Tax receipt showing the name of the person in whose name property is being assessed.
  • Proof of payment of Ground Rent from the society [in case of a Co-operative Society Plot]

G) In case of by way of Gift Deed

Substitutions of name/inclusion of name in the lease deed/ sub-lease deed, by way of gift deed.

  • Affidavit of Donor.
  • Affidavit of Donee.
  • Indemnity Bond to be submitted by Donor.
  • Indemnity Bond to be submitted by Donee.
  • Gift deed substitution of name of family member.
  • Gift deed [inclusion of name of family member.
  • Proof of relationship of donee with the donor viz, copy of passport or copy of ration card or voter’s identity cards etc. duly attested.
  • One photograph and three specimen signatures of donee duly attested by Class-I Gazetted Officer/Magistrate Ist class.
  • No dues Certificate from the Society in case of a Cooperative Society

Delhi Development Authority

A) In case of Transfer: –
